Personal Injury Award of $1.2 Million
MF, MM and EF were two brothers and a sister who were standing by their bicycles on Kelly (East River) Drive in Philadelphia, near a heavy metal gate that the City used to block off motor vehicles from this portion of the drive for the benefit of bicyclists and joggers. When a motorist approaching this gate crashed into it, it caused the gate to swing into our clients. This resulted in several broken bones and some internal organ contusions to MF and EM. Although the driver had only modest insurance, our injury attorneys were able to show the City of Philadelphia to be negligent for failing to provide sufficient notice to motorists on the road as they approached this gate to warn them of the closure of the road.
